About Professional Tax
Professional Tax is a direct tax levied and collected by state governments in India. It is applicable to individuals earning income through salary or practicing professions such as chartered accountants, company secretaries, lawyers, doctors, etc.
It is governed under Article 276(2) of the Indian Constitution. Employers deduct professional tax from employees’ salaries every month and deposit it with the state government on their behalf.

Types of Professional Tax

Employers
Employers must obtain a Registration Certificate. They are responsible for deducting the applicable professional tax from their employees’ salaries and depositing it with the respective state government.
Self-employed Persons
Individuals engaged in business, trade, or practicing a profession independently must obtain an Enrolment Certificate and pay the tax themselves to the state government.
General Exemptions
While the rules vary across different states, governments generally provide exemptions to specific categories of individuals.
Armed Forces
Members serving in the Indian Navy and other specified armed forces are generally completely exempted from paying professional tax.
Guardians of Disabled
Parents or legal guardians of children suffering from a mental disability or any permanent physical disability are eligible for exemption.
Physical Disabilities
Individuals suffering from permanent physical disabilities, including blindness, are commonly exempted from this tax burden.
Senior Citizens
In many states, individuals who have attained the age of 65 years or older are no longer required to pay professional tax.

Mandatory Coverage
All structured businesses, including Private Companies, LLPs, and Partnership Firms, must register for Professional Tax.
30-Day Timeline
The registration process must be completed within 30 days of hiring employees to avoid serious non-compliance penalties.
Multiple Locations
If a business operates across multiple states or locations, separate registrations are required for each jurisdiction.
Penalties for Non-Compliance
Failure to register, deduct, or pay professional tax on time attracts severe penalties that can disrupt your business operations.
Late Registration Penalty
Delaying the registration process attracts a strict penalty, typically calculated at ₹5 per day of delay.
Late Payment Penalty
Failing to deposit the deducted tax on time leads to a flat penalty of 10% on the total tax amount due.
