DIN KYC (DIR-3 KYC)
A mandatory compliance for all Directors and Designated Partners
What is DIN and DIR-3 KYC?
DIN (Director Identification Number) is a unique Identification Number allotted to an individual who is appointed / proposed to be appointed as a director of a company or designated partner in a Limited Liability Partnership (LLP).
From the financial year 2019-2020 onwards, it became mandatory for every director or designated partner who has been allotted a DIN on or before the end of the financial year, and whose DIN is in approved status, to ensure his/her DIN KYC is done through e-form DIR-3 KYC before 30th September of the immediately next financial year.
Reason for DIN KYC and Benefits
The main motive behind the filing of the DIR-3 KYC form is to conduct the annual KYC of all company and LLP directors to ensure proper corporate governance.
Updated MCA Database
It updates the Ministry of Corporate Affairs (MCA) database of all directors having a DIN, reflecting the current status of each director and designated partner on the MCA portal.
Consequences of Not Filing e-Form DIR-3 KYC
Missing the specified deadline for filing DIR-3 KYC can lead to immediate complications for the director and their associated organizations.
DIN Deactivation & ₹5,000 Penalty
In case the director who is supposed to file the Form does not file it by 30th September on the MCA 21 portal, the department will mark the DIN of such director as ‘Deactivated due to Non-filing of DIR-3 KYC’. If the director wishes to re-activate their DIN in the future by filing the missed Form DIR-3 KYC, they can do so after paying a late fee of ₹5,000.
Categories of DIR-3 KYC Filing
Based on the requirements of clients, DIN KYC can be categorized in two ways. Click on the folders below to learn more about each category.
First Time / With Updation
This category involves filing of DIN KYC for the first time, or in cases where the director or designated partner wants to update certain details (like address, phone, email) in their previously submitted DIN KYC.
Without Updation (DIR-3 KYC Web)
Any DIN holder who has already submitted e-Form DIR-3 KYC in any previous financial year and does not require an update in any of his/her KYC details can perform the annual KYC simply by accessing the DIR-3 KYC web service. It is used to verify the existing data.
Documents Required for e-Form DIR-3 KYC (With Updation)
If you are filing for the first time or need to update your details, ensure you have the following documents ready:
- Details of Nationality
- Voters ID / Passport / Driving License
- PAN Card
- Aadhaar Card
- Personal E-mail ID and Mobile Number
- Proof of Residential Address
- Digital Signature Certificate (DSC)
- Attestation from CA, CS, or Cost Accountant
